Townsville Man Sentenced for Trespass, Wilful Damage

A 33-year-old man has been sentenced in the Townsville Magistrates Court for trespassing and causing wilful damage to a local business.

Details of the Offence

Bradley Thomas Phillips appeared before the court on charges stemming from an incident that occurred on March 15, 2023. The court heard that Phillips unlawfully entered a commercial property on Flinders Street and caused damage to several items inside.

Police prosecutor Senior Constable Lisa Thompson told the court that the damage was estimated at $2,500. The business owner reported the incident after discovering broken windows and damaged furniture.

Defence Submission

Defence lawyer Sarah Mitchell argued that her client had been under the influence of alcohol at the time of the offence and had no recollection of the events. She stated that Phillips had expressed genuine remorse and was willing to pay restitution.

“Mr. Phillips has struggled with alcohol addiction, but he is now seeking help and has taken steps to address his issues,” Mitchell said.

Magistrate’s Remarks

Magistrate John Smith acknowledged the seriousness of the offences but noted that Phillips had no prior criminal record. He emphasised the importance of accountability and the impact on the local business community.

“Trespassing and causing wilful damage are serious matters that affect not only the property owner but also the broader community. However, I take into account your early guilty plea and efforts to rehabilitate,” Magistrate Smith said.

Sentence

Phillips was sentenced to 12 months of probation and ordered to pay $2,500 in restitution to the victim. He was also required to attend alcohol counselling sessions.

The magistrate warned that any further offences would result in more severe penalties.
