A Newcastle grandfather has avoided a prison sentence after pleading guilty to brandishing a firearm during a terrifying road rage incident. John Michael Fletcher, 62, was sentenced in Newcastle Local Court on Thursday to an 18-month community corrections order for the offence, which occurred in February this year.
The Incident
According to court documents, the incident began when Fletcher became involved in a dispute with another motorist on the Pacific Highway at Mayfield. The argument escalated, and Fletcher allegedly produced a handgun and pointed it at the other driver. The victim, who was left shaken but unharmed, immediately reported the matter to police.
Police arrested Fletcher later that day at his home in the Newcastle suburb of Wallsend. During a search of the property, officers seized a licensed firearm and ammunition. Fletcher was charged with using a firearm to cause fear, possessing a firearm in a public place, and possessing ammunition without a licence.
Court Proceedings
In court, Fletcher's lawyer argued that his client had no prior criminal history and had shown genuine remorse for his actions. The lawyer also highlighted that Fletcher was a grandfather and a respected member of the community. Magistrate Ian Cheetham acknowledged these factors but noted the seriousness of the offence.
"This was a very concerning incident that could have had tragic consequences," Magistrate Cheetham said. "However, I accept that Mr Fletcher is unlikely to reoffend and that a custodial sentence would have a significant impact on his family."
The magistrate imposed an 18-month community corrections order, which requires Fletcher to perform 200 hours of community service and undergo supervision by Community Corrections. His firearms licence was also revoked, and he was ordered to pay court costs.
Reaction
Outside the court, Fletcher declined to comment. However, his lawyer stated that his client was relieved to have avoided jail and was committed to fulfilling the conditions of his sentence.
The victim, who did not attend court, released a statement through police expressing satisfaction with the outcome. "I am glad that justice has been served and that this matter is now behind me," the statement read.
Police have welcomed the sentence, warning that road rage incidents involving weapons will not be tolerated. "This should serve as a reminder to all motorists that aggressive behaviour behind the wheel can have serious consequences," a police spokesperson said.
