A Canberra man has avoided an immediate jail term for his role in a violent assault outside the Mooseheads nightclub in the city's nightlife district. Ty Broers, 21, was sentenced in the ACT Supreme Court on Friday to 18 months in prison, wholly suspended for two years, after pleading guilty to one count of recklessly inflicting grievous bodily harm.

The Incident

The court heard that the attack occurred in the early hours of March 13, 2021, when Broers and another man confronted the victim, a 22-year-old man, outside the popular nightspot on Bunda Street. The victim was punched and kicked repeatedly, suffering a fractured eye socket, a broken nose, and significant bruising. He required surgery and has since experienced ongoing vision problems.

Court Proceedings

Justice David Mossop noted that Broers had a prior criminal record but described the offending as "out of character." The judge accepted that Broers had shown genuine remorse, had made efforts to rehabilitate, and had strong family support. A pre-sentence report indicated Broers was at low risk of reoffending.

"The community expects that those who engage in violent conduct, particularly in the context of the night-time economy, will be held to account," Justice Mossop said. However, he added that a suspended sentence was appropriate given the circumstances and Broers' prospects for rehabilitation.

Victim Impact

The victim, who cannot be named for legal reasons, provided a victim impact statement describing the lasting physical and psychological effects of the assault. He said he had suffered from anxiety and had difficulty sleeping, and that the incident had affected his ability to work and socialize.

Legal Consequences

In addition to the suspended sentence, Broers was ordered to perform 200 hours of community service and to pay $5,000 in compensation to the victim. He was also placed on a two-year good behavior bond. The co-accused, a 22-year-old man, is still before the courts.

Outside court, the victim's family expressed disappointment with the sentence, saying they felt it did not reflect the severity of the injuries. However, prosecutors said the sentence was within the acceptable range for such cases.

The case has once again highlighted concerns about alcohol-fuelled violence in Canberra's nightlife precinct, with community groups calling for stricter enforcement and harsher penalties for offenders.
