A forensic pathologist has expressed uncertainty regarding the cause of death of two-year-old Summer Fleming, whose mother's former partner is on trial for her murder in the Newcastle Supreme Court.
Key Testimony in Court
Dr. Sarah Jones, a forensic pathologist with over 20 years of experience, told the court on Tuesday that she could not definitively determine how Summer died. The toddler was found unresponsive at a home in Newcastle West in October 2022 and later died in hospital.
The accused, 34-year-old Mark Reynolds, has pleaded not guilty to murder. The prosecution alleges that Reynolds caused fatal injuries to Summer while her mother was at work.
Pathologist's Findings
Dr. Jones conducted the post-mortem examination and noted several injuries, including bruising to the head and torso, but said the exact cause of death was not clear. "There were findings consistent with inflicted trauma, but I cannot say with certainty that these injuries alone caused her death," she testified.
The pathologist acknowledged that some injuries could have been accidental, but the pattern and severity raised concerns. She also mentioned that there was no evidence of natural disease that could explain the death.
Defense Cross-Examination
Under cross-examination by the defense, Dr. Jones conceded that the lack of a definitive cause of death could leave room for alternative explanations. The defense has suggested that Summer may have had an undiagnosed medical condition.
The trial continues before Justice Peter Harrison, with further medical experts expected to give evidence.
Community Impact
The case has drawn significant attention in Newcastle, with community members expressing shock and grief over the toddler's death. A small vigil was held outside the court on Tuesday, with attendees holding signs calling for justice for Summer.
The trial is expected to last several weeks.
