Berkeley man, 76, found guilty of sexual touching

A 76-year-old man from Berkeley has been found guilty of sexually touching a woman, following a trial in the Wollongong District Court. The incident, which occurred at a home in the suburb, involved the man inappropriately touching the woman without her consent.

The court heard that the victim was at the residence when the offender, whose name has been suppressed to protect the victim's identity, engaged in the unlawful act. The jury deliberated for several hours before returning a guilty verdict on one count of sexual touching.

During the trial, the prosecution presented evidence including testimony from the victim and other witnesses. The defence argued that the touching was accidental, but the jury rejected this claim. Judge Andrew Haesler SC commended the jury for their careful consideration of the evidence.

The man, who has no prior criminal record, was granted bail pending sentencing. He will face court again in March for a sentencing hearing. The maximum penalty for sexual touching is five years' imprisonment.

Outside the court, the victim's family expressed relief at the verdict, stating that justice had been served. They thanked the police and the court for their support throughout the legal process.

This case highlights the importance of reporting sexual offences and the commitment of the justice system to holding offenders accountable, regardless of age. The court also noted the need for community awareness about consent and respectful behaviour.
