The ACT Supreme Court has handed down a sentence to a man convicted of attacking his uncle with a shovel, an incident that left the victim with severe injuries. The court was told that the assault, which occurred in Canberra, was unprovoked and stemmed from a family dispute.
Details of the Attack
On the day of the incident, the offender approached his uncle while he was working in his garden. Without warning, he struck the victim multiple times with a shovel, causing fractures to his skull and arm. The victim was rushed to hospital and underwent emergency surgery. He has since been recovering but continues to suffer from the psychological trauma of the attack.
Court Proceedings
During the sentencing hearing, the prosecution argued that the attack was a serious breach of trust, given the familial relationship. The defence submitted that the offender had been under significant stress and had sought help for his mental health issues prior to the incident. However, the judge noted that the use of a weapon and the severity of the injuries warranted a custodial sentence.
The court also considered the offender's guilty plea and his expressions of remorse. Nevertheless, the judge emphasised the need to deter such violent acts and to protect the community.
Sentence Imposed
Justice David Mossop sentenced the man to four years and six months in prison, with a non-parole period of two years and three months. The sentence takes into account the time already served in custody. The offender was also ordered to undergo counselling and to have no contact with the victim for the duration of his sentence.
The victim, who was present in court, said he felt relieved that justice had been served but added that the family rift caused by the attack would take a long time to heal.
