A 33-year-old man has been accused of raping a prospective housemate in Canberra after she fell asleep following a dinner at his home, according to police allegations presented in court.

Court hears details of alleged assault

Hassan Farid U Din Virk appeared in the ACT Magistrates Court on Tuesday, January 6, 2026, charged with one count of sexual intercourse without consent. He has not yet entered a plea.

Police allege the incident occurred in early January 2026. The woman, who was considering moving into the residence, had dinner with Virk at his home around 5pm. Court documents state that a short time later, the woman fell asleep.

It is alleged she woke up later that evening to find Virk sexually assaulting her in his bed.

Arrest and bail conditions imposed

Police were called to the address about 11:30pm for an unrelated matter. After speaking with the woman, officers took her to hospital for assessment and arrested Virk.

During the bail hearing, prosecutor Corinne Kennedy initially opposed release, citing concerns about potential interference with evidence. However, this opposition was later withdrawn.

Magistrate granted Virk bail with strict conditions, including that he must surrender his passport and reside in Moruya, a town on the New South Wales South Coast. He is scheduled to return to court in late January 2026.

In a statement following the court appearance, ACT Policing reminded the community that support is available for anyone affected by sexual violence. Reports can be made by attending a police station or calling 131 444.

The police also noted that historical sexual assaults, incidents occurring more than six months ago, can be reported online.
