Pregnant Woman Allegedly Choked, 'Terrified' for Safety as Ex-Partner Denied Bail

A woman who was allegedly choked while pregnant has told a court she is "terrified" that her ex-partner will kill her, leading to his bail being refused due to significant safety concerns. The alleged attacker's bid for release was denied in the ACT Magistrates Court on Thursday, April 9, 2026, after prosecutors argued he posed a high risk of reoffending and showed a consistent disregard for legal orders.

Details of the Alleged Assault and Charges

The man, whose identity has been withheld to protect the alleged victim, is accused of assaulting his former partner in August 2025 and breaching a family violence order twice in March 2026. He faces serious charges including choking, suffocating or strangling another person, aggravated assault, and contravening a family violence order, though he has not yet entered pleas. The court heard that the woman came forward to police while the man was serving a suspended sentence for a previous assault, highlighting ongoing fears for her and her children's safety.

Court Proceedings and Bail Refusal

During the bail hearing, a prosecutor emphasized the man's criminal history and "consistent disregard for court orders," stating there was no confidence he could comply with bail conditions. "Looking at the history, we have no confidence that the defendant is able to comply with any conditions designed to ameliorate the likelihood of him committing further offences," she said, adding, "He's simply not a candidate for bail." A defence lawyer argued that strict conditions could be managed, but Magistrate James Lawton agreed with the prosecution, citing a likelihood of reoffending if bail were granted.

Additional Incidents and Arrest

The man came to police attention on Wednesday, April 8, during random drug and alcohol testing in Yarralumla. Authorities allege he failed to stop when directed, drove on the wrong side of the road, and later returned a positive roadside drug test for methamphetamine. This led to his arrest and additional charges, including failing to stop for police, drug driving, and reckless driving, further complicating his legal situation.

Magistrate Lawton denied bail, stating he was not satisfied any conditions could reduce the risk of further offences. The 33-year-old will face court at a later date for the charges.
