Russia's Ministry of Defence claimed the yacht was on a collision course and failed to respond to radio calls and flares. They stated that warning shots were fired "in strict accordance with international navigation laws." Jane refuted this, saying, "They didn't fire flares, they didn't get on the radio to us. We weren't in the way, we were not about to collide with them at all." She also noted that their AIS transponder was on and they were sailing, not motoring.
