A Canberra man has been handed a suspended sentence for a crash that killed a motorcyclist, with a court hearing of the family's ongoing grief. Sean Joshua Walton, 43, was sentenced in the ACT Supreme Court after being found guilty of negligent driving causing the death of 47-year-old Craig O'Neill on June 18, 2024.
Justice Peter Berman sentenced Walton to a suspended term of imprisonment, noting the tragic nature of the incident. The court heard victim impact statements from Mr. O'Neill's family, including his daughters, who described their loss. One daughter said she still says goodnight to her father each night beside a shrine in her bedroom.
The crash occurred when Walton, driving an Isuzu tipper truck, turned right at an intersection in Holt and collided with Mr. O'Neill's Harley-Davidson motorcycle. The prosecution argued Walton failed to keep a proper lookout, while the defense described it as a tragic mistake.
The court also heard that Mr. O'Neill's daughters had tried to reach him for their nightly phone call as he lay dying on the road. The family expressed that their lives would never be the same, with the mother stating, 'A member of our family is missing, taken from us because someone was too impatient.'
