A Canberra man has avoided a jail sentence after pleading guilty to causing the death of a motorcyclist in a crash on the Barton Highway in May 2022.

Sean Joshua Walton, 22, was sentenced in the ACT Supreme Court on Friday to a two-year suspended prison sentence after he pleaded guilty to one count of culpable driving causing death.
The court heard that Walton was driving a Toyota Hilux on the Barton Highway near Hall when he attempted to overtake a line of vehicles and collided with a motorcycle being ridden by 54-year-old Craig O'Neill.
O'Neill died at the scene.
Judge's Remarks
Justice David Mossop said Walton's actions were a "grossly negligent" act that fell "well below the standard of care expected of a reasonable driver".
However, he said Walton had shown genuine remorse and had good prospects of rehabilitation.
Sentence Conditions
Walton was sentenced to two years in prison, wholly suspended for two years. He was also disqualified from driving for three years and must complete 200 hours of community service.
Justice Mossop said the sentence was designed to punish Walton and deter others from similar behaviour, while also allowing him to address his issues in the community.
Family Impact
In a victim impact statement read to the court, O'Neill's family described him as a loving father, son, and brother who was taken too soon.
They said the crash had left a "hole in our hearts that will never be filled".
Walton's lawyer said his client was "deeply sorry" for his actions and would carry the burden of O'Neill's death for the rest of his life.
