The Texas Supreme Court has ruled unanimously against environmental organizations seeking to block SpaceX from closing Boca Chica Beach during rocket launches, upholding a trial court's dismissal of the lawsuit. The decision means the beach near SpaceX's Starbase facility in Brownsville is likely to remain closed during future launch operations.

Court Ruling on Legal Standing

The court's opinion, authored by Justice Rebeca Huddle, concluded that the plaintiffs—Save RGV, the Sierra Club, and the Carrizo/Comecrudo Tribe of Texas—did not have legal standing to sue. The 2009 constitutional amendment protecting beach access explicitly states that private parties cannot bring lawsuits to enforce those protections, the court found. "Because the claims are not viable, it follows that the defendants, all of whom are governmental actors, retain their immunity from suit," Huddle wrote.

Background of the Legal Challenge

The lawsuit began in 2021 when Save RGV filed suit against the Texas General Land Office, Commissioner Dawn Buckingham, and Cameron County. The group argued that closing Boca Chica Beach and State Highway 4 during SpaceX launches violated the Texas Constitution, which was amended in 2009 with 77% voter support to protect public beach access. The 2013 state law, House Bill 2623, allowed SpaceX to temporarily close the beach for safety reasons, amending the Open Beaches Act. The Federal Aviation Administration approved the launch site after SpaceX demonstrated authority to limit access under that law.

Environmentalists' Response

Marisa Perales, attorney for the environmental groups and the tribe, told the Texas Tribune that the ruling "elevates SpaceX's interests over Texans' rights." She added: "The government has essentially given Boca Chica Beach to SpaceX to use as its blast zone for its rocket launches and other related activities, and the supreme court appears to have endorsed that decision, by saying that the affected public has no remedy to enforce their constitutional right to access their own beach." Save RGV had argued the closures were a "premeditated scheme by a private company, with the State's help, to take control of public land for its own profit."

Impact on Public Access

The ruling means Boca Chica Beach will likely close during future SpaceX launches. The company's Starbase facility, where Starship rockets are developed and launched, has a blast radius that includes the beach. SpaceX went public earlier this month in the largest stock market debut in history, making CEO Elon Musk the world's first trillionaire.
